Selon le [Code civil · Art. 324 bis 1], tout acte portant mutation d'immeuble ou de droits immobiliers doit revêtir la forme authentique. Les pièces à réunir : titre de propriété, extrait de naissance des parties, certificat de situation fiscale et certificat négatif d'hypothèque.

L'hypothèque nécessite-t-elle un acte notarié ?

Oui. L'article [Code civil · Art. 883] précise que l'hypothèque ne peut être constituée qu'en vertu d'un acte authentique, d'un jugement ou de la loi. Les frais sont à la charge du constituant sauf convention contraire.
